Brent Warner concentrates his practice in the areas of business, contract and commercial litigation. He has significant experience with representing automotive suppliers, lending institutions, brokerage firms and retail stores in state, federal and commercial arbitration forums. Mr. Warner has also participated with Detroit Legal Aid and Community Legal Resources handling numerous litigation matters pro bono. Prior to becoming a member at Brooks Wilkins Sharkey & Turco, he was a litigation associate at Butzel Long.

 

Recent Experience Includes:

 

• On behalf of Tier I and II automotive suppliers located throughout the United States and abroad including Canada, Mexico and Europe, negotiated and drafted terms and conditions of multimillion dollar contracts for the purchase and sale of unique automotive components
• Successfully defended numerous manufacturers against claims for both pre and post termination sale commissions and damages allocable under the Uniform Michigan Sales Representative Act
• Successfully negotiated a $2M termination claim on behalf of a Tier I automotive supplier

• Successfully represented numerous suppliers in obtaining injunctive relief and defending against motions for injunctive relief
• On behalf of a tooling supplier, successfully pursued monies owed for tool fabrication and defended against a breach of contract counterclaim
• Successfully represented numerous suppliers in obtaining injunctive relief and defending against motions for injunctive relief
• On behalf of a major bank, won summary disposition and an award of $2M in damages plus attorney fees in a case involving a breach of a commercial loan and guaranty agreement
• On behalf of a partnership, won summary disposition and an award of $80,000 in damages plus attorney fees stemming from a breach of a partnership agreement
• Member of a team that won an award of over $6M on behalf of an aerospace manufacturer in an arbitration involving a breach of contract claim
• On behalf of a lending institution won summary disposition and successfully defended against a claim arising under the Retail Installment Sales Act and seeking over $100,000 in damages
• Successfully defended an investment broker and associated brokerage firm against claims of negligence and unsuitability
• Successfully pursued a major lending institution’s indemnification rights under the Uniform Commercial Code with respect to a fraudulent endorsement including an award of attorney fees
